The rules for using Split
- Split gives general training guidance. It is not medical advice. You are responsible for deciding whether you are healthy enough to train, and you train at your own risk.
- Subscriptions renew automatically until you cancel. Athlete subscriptions are billed and cancelled through the App Store or Google Play. Coach subscriptions are billed through Stripe and cancelled from your billing page.
- Your training data stays yours. We need a licence to process it so the Service can work, and nothing more.
- Use one account per person, keep it secure, and don't abuse the Service or other people on it.
- The Service is provided as-is and our liability to you is limited, to the extent the law allows.
This summary is for orientation only. The full text below governs.
Accepting these Terms
By creating an account, tapping or clicking a button that says you agree, or otherwise using the Service, you accept these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
If you use the Service on behalf of a coaching business or other organization, you represent that you have authority to bind that organization, and “you” includes it.
Eligibility and accounts
- You must be at least 16 years old to use the Service. By using it you represent that you are.
- Provide accurate information and keep it current. One account per person; do not share your login or let anyone else use your account.
- You are responsible for everything that happens under your account and for keeping your password and devices secure. Tell us right away at support@getsplit.ai if you suspect unauthorized access.
- We may refuse, suspend, or close accounts that violate these Terms, that we reasonably believe are fraudulent or abusive, or that put the Service or other users at risk.
The Service
Split is a training log paired with an AI running coach that builds a race plan, adjusts it as you train, and gives workout-by-workout feedback. It also provides a workspace where human coaches can manage athletes, review training, and message them.
- AI-generated content. Plans, feedback, and messages from the AI coach are generated automatically by a machine-learning model. They can be wrong, incomplete, or inappropriate for your situation. Use your own judgment and review any plan change before following it.
- Ongoing development. We may add, change, or remove features, impose or adjust usage limits (for example on coach messages), and take the Service offline for maintenance. We will try to give notice of material changes but cannot always do so.
- Third-party data. Data imported from Strava, Garmin, or other platforms is provided by those platforms and may be delayed, missing, or inaccurate. We are not responsible for their availability or accuracy.
Health, safety, and assumption of risk
Please read this section carefully. It limits what you can rely on the Service for.
- The Service provides general fitness and training information. It is not medical, nutritional, physiotherapy, or other professional advice, and nothing in it creates a doctor-patient or similar relationship. The AI coach and any human coach using the Service are not your healthcare providers.
- Running and other exercise carry inherent risks, including injury, illness, cardiac events, and death. Consult a physician before starting or changing a training program, particularly if you have or suspect a heart condition, are pregnant, have an injury, or have not exercised regularly.
- Stop exercising and seek medical help immediately if you feel pain, dizziness, chest discomfort, or shortness of breath beyond normal exertion. Never rely on the Service in an emergency.
- You are solely responsible for deciding whether a workout, plan, or piece of advice is appropriate for you, for the conditions you train in, and for your own safety. To the fullest extent permitted by law, you voluntarily assume all risk arising from your use of the Service and any training you undertake in connection with it.
Subscriptions, trials, and billing
Athlete subscriptions (mobile app)
- Access to the app requires a paid subscription after any free trial or introductory period. Prices, billing periods, and trial length are shown in the app before you subscribe.
- Purchases are made through the Apple App Store or Google Play and are subject to that store's terms. The store, not Split Running Co., charges your payment method and issues any refunds under its own policy. We cannot refund a store purchase directly.
- Automatic renewal. Your subscription renews automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the period ends. A free trial converts to a paid subscription unless cancelled before the trial ends.
- Cancel or manage your subscription in your App Store or Google Play account settings. Deleting the app does not cancel a subscription. After cancelling you keep access until the end of the period you paid for.
- Where we grant courtesy access without a subscription (for example a grace period for a new account), we may end that access at any time.
Coach subscriptions (web)
- Coach plans are billed by Split Running Co. through Stripe on a recurring basis at the price and seat limits shown on the pricing page or in your billing settings. By subscribing you authorize recurring charges to your payment method until you cancel.
- Plans renew automatically. You can upgrade, downgrade, or cancel from your billing page at any time; changes are prorated where stated and cancellations take effect at the end of the current billing period. Except where required by law, fees are non-refundable.
- If a payment fails we may retry it and, after notice, suspend or downgrade the account until it is resolved.
All subscriptions
- Prices exclude taxes unless stated. You are responsible for any applicable taxes, which the store or Stripe may add at checkout.
- We may change prices. Changes apply from your next renewal and we will notify you in advance, either directly or through the app store, so you can cancel before the new price takes effect.
- Promotional offers, credits, and founder or legacy pricing may have additional conditions and may be withdrawn at any time for new periods.
Additional terms for coaches
If you register as a coach, these additional terms apply to you.
- You are the coach. You are solely responsible for the advice, plans, and messages you give athletes, for having any qualifications, insurance, or licences your jurisdiction requires, and for your own agreements with your athletes. Split Running Co. is a software provider and is not a party to your coaching relationship.
- Athlete data.You may use an athlete's data only to coach that athlete through the Service. You may not export it in bulk, sell it, share it with third parties, use it for marketing, or retain it after the athlete ends the relationship except as required by law.
- Managed profiles.If you create a profile for an athlete who has not joined the Service themselves, you represent that you have that person's permission to enter their information, that they are at least 16, and that you will delete the profile if they ask.
- Seats and limits. Your plan determines how many athletes you can manage and how many AI coach messages are included. We may enforce these limits in the product.
- Your athletes' accounts are theirs. Athletes can end the coaching link, delete their account, or withdraw consent at any time, and we will honour that even if it affects your roster.
Acceptable use
You agree not to:
- use the Service for anything unlawful, harmful, or fraudulent;
- harass, threaten, or abuse other users, coaches, or our staff, or post content that is hateful, sexually explicit, or that infringes anyone's rights;
- access another person's account or data without authorization, or attempt to;
- use the AI coach to generate content unrelated to running or training, to attempt to extract its instructions, or to circumvent its safety behaviour;
- scrape, crawl, or bulk-download the Service or its data, or use automated means to access it other than through interfaces we provide;
- bypass or overload rate limits, subscription checks, or other technical protections, or interfere with the Service's operation;
- reverse engineer, decompile, or copy any part of the Service except where the law expressly allows it;
- resell, sublicense, or provide the Service to others as a standalone offering, or build a competing product using our content or data;
- upload malware or content that damages the Service or other users' devices;
- use the Service in violation of the terms of any connected platform such as Strava or Garmin.
We may investigate suspected violations and remove content, suspend, or terminate accounts without notice where we reasonably believe it is necessary.
Your content and data
- You own your content. Your activities, notes, messages, and other material you submit (“Your Content”) remain yours.
- Licence to us. You grant Split Running Co. a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, display, and create derivative works of Your Content solely to operate, secure, support, and improve the Service for you, including sending relevant portions to our AI provider to generate coaching. This licence ends when you delete the content or your account, except for copies in backups for a limited period and data we must retain by law.
- Your responsibilities. You represent that you have the rights needed to submit Your Content and that it does not violate these Terms or anyone else's rights.
- Feedback. If you send us suggestions or feedback, we may use them without obligation to you.
Third-party services
The Service connects to platforms such as Strava, Garmin, Apple, and Google. Your use of those platforms is governed by their terms and privacy policies, and you authorize us to access your data from them when you connect. We are not responsible for third-party services, their availability, or how they handle your data. You can revoke a connection at any time from the platform or from your Split profile.
Strava-sourced data is used in accordance with the Strava API Agreement and is never displayed publicly or shared beyond what our Privacy Policy describes.
Our intellectual property
The Service, including its software, design, workout library, coaching logic, text, graphics, logos, and the Split name and marks, is owned by Split Running Co. or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app and website for their intended purpose in accordance with these Terms. All other rights are reserved. Plans and feedback generated for you may be used for your own training; you may not republish them commercially or present them as your own coaching product.
Termination
- By you. You may stop using the Service and delete your account at any time from Profile → Security in the app, or by emailing support@getsplit.ai. Deleting your account does not cancel an app store subscription; cancel that in your store settings.
- By us. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, if your subscription lapses, or if we discontinue the Service. If we discontinue the Service entirely we will give reasonable notice and, for prepaid coach plans, refund any unused portion.
- Effect. On termination your licence ends and we may delete your data as described in the Privacy Policy. Sections that by their nature should survive (including 4, 8, 10, and 12 through 16) survive termination.
Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY TRAINING PLAN, FEEDBACK, OR OTHER CONTENT WILL BE ACCURATE, SAFE, OR SUITABLE FOR YOU, OR THAT FOLLOWING IT WILL PRODUCE ANY PARTICULAR RESULT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SPLIT RUNNING CO. AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES, OR FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR TRAINING OR EXERCISE, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) FIFTY U.S. DOLLARS (US$50).
Some jurisdictions do not allow some of these limitations. In those places our liability is limited to the greatest extent the law allows. Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by our negligence where such exclusion is not permitted, or for fraud.
Indemnification
You agree to defend, indemnify, and hold harmless Split Running Co. and its officers, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or relating to Your Content, your use of the Service, your breach of these Terms, your violation of any law or third-party right, or, if you are a coach, the coaching services you provide to your athletes.
Governing law and disputes
- Governing law. These Terms and any dispute arising out of them are governed by the laws of the State of Delaware and the federal laws of the United States, without regard to conflict-of-law rules. If you are a consumer in a jurisdiction whose law gives you mandatory protections, those protections still apply.
- Talk to us first. Before starting any formal proceeding, email support@getsplit.ai with a description of the dispute and give us 30 days to try to resolve it informally. Most issues are resolved this way.
- Venue. Any claim that cannot be resolved informally must be brought in the state or federal courts located in the State of Delaware, and you consent to their jurisdiction, except that either party may bring an eligible claim in small-claims court, and we may seek injunctive relief anywhere to protect our intellectual property.
- No class actions. To the extent permitted by law, claims must be brought on an individual basis and not as a plaintiff or class member in any purported class or representative proceeding.
- Time limit. To the extent permitted by law, any claim must be filed within one year after it arises or it is permanently barred.
App store terms
If you downloaded the app from the Apple App Store, these additional terms apply. This agreement is between you and Split Running Co. only, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it. To the extent any warranty applies and is not disclaimed, you may notify Apple of a failure to conform and Apple will refund the purchase price to you; Apple has no other warranty obligation. Split Running Co., not Apple, is responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, and consumer protection claims, and for investigating and resolving any third-party intellectual property claim. You represent that you are not located in a country subject to a U.S. government embargo or designated a “terrorist supporting” country and are not on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Where these Terms are less restrictive than or conflict with Apple's Licensed Application End User License Agreement, the Apple terms control for the App Store version.
If you downloaded the app from Google Play, Google's terms of service apply in addition to these Terms, and Google is not responsible for the app or these Terms.
General
- Changes to these Terms. We may update these Terms. The date at the top shows the current version. For material changes we will notify you by email or in the app before they take effect. Continued use after that date means you accept the updated Terms. If you do not agree, stop using the Service and delete your account.
- Entire agreement. These Terms, the Privacy Policy, and any plan-specific terms shown at purchase are the entire agreement between you and us about the Service and replace any prior agreements.
- Severability. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest of the Terms remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Export and sanctions. You may not use the Service where prohibited by U.S. export control or sanctions laws.
- Notices. We may notify you by email to the address on your account or in the app. Notices to us go to support@getsplit.ai.
